An Ohio mom and her same-sex partner are filing a suit against a Chicagoland fertility clinic for using sperm from a black donor for artificial insemination instead of the white donor’s sperm that she had selected.

Jennifer Cramblett, 36, of Uniontown, Ohio, was quick to react to the press when many would claim her being racist. She claimed, as a lesbian, she knows what discrimination feels like. She doesn’t want her daughter, Payton, to feel the same pain because of the color of her skin. Ok, maybe she has known some discrimination in her time, but it has to impossible to compare the two considering age and race on one side, and sexual preference on the other. Not all bigots are created equally.

According to the lawsuit, the 2-year-old girl is already facing racial prejudice in Uniontown, a  small Ohio town of 3,300 people which happens to be 97% white. It’s hard to believe anyone could be prejudiced against a toddler, but who knows.

The lawsuit was filed Monday against Midwest Sperm Bank for wrongful birth and breach of warranty, citing emotional and economic damage.

After going through numerous donor profiles from Midwest Sperm Bank three years ago, Cramblett and her partner settled on donor No. 380, who was white. Cramblett used the sperm to get pregnant and, months later, the two decided to reserve more sperm from that donor so her could give birth to a sibling also related by blood.

It turns out a clerical error by the sperm bank was to blame for the error. An employee at the allegedly misread a handwritten order and sperm from donor No. 330, who was black was used rather than No. 380 which is the one the couple had chosen.

“How could they make a mistake that was so personal?” Cramblett told reporters.

The clinic allegedly sent an apology letter and a refund for the wrong batch but obviously that wasn’t going to cut it in this case.

“Jennifer was crying, confused and upset,” according to the court papers. “All of the thought, care and planning that she and her partner had undertaken to control their baby’s parentage had been rendered meaningless. In an instant, Jennifer’s excitement and anticipation of her pregnancy was replaced with anger, disappointment and fear.”

Ok, this couple definitely would seem to have a legitimate beef. People want what they paid for right. If you buy a green car, you don’t expect a red one after all. Not so fast though, this is where the lawsuit gets a sticky and plain out uncomfortable to even read.

Cramlett’s attorney, Thomas Intili, said his client “did not encounter any African-American people until she entered college. Not all her friends and family members are racially sensitive.”

The couple reportedly moved from Akron, Ohio, to Uniontown to be near better schools and Cramblett’s family. Now therapists are advising them to move to a more racially diverse community, the lawsuit stated.

Here’s the issue that really takes the cake though. Hair care for baby is mentioned in the lawsuit!

“Getting a young daughter’s hair cut is not particularly stressful for most mothers, but to Jennifer it is not a routine matter, because Payton has hair typical of an African-American girl,” it said. “To get a decent cut, Jennifer must travel to a black neighborhood, far from where she lives, where she is obviously different in appearance, and not overtly welcome. I don’t want her to ever feel like she’s an outcast.”, Cramblett told NBC News.

Make what you will of those statements but doesn’t seem like someone who has “known discrimination” as Cramblett previously stated.

The lawsuit seeks a minimum of $50,000 in damages. I kind of hope they don’t get a dime after some of those statements. No doubt it seems like the fertility clinic made a mistake. They should’ve just stuck with those facts when it comes to the lawsuit. After making a few of those sketchy statements I don’t expect them to get too much sympathy from anyone. What a shame a two year old toddler is caught up in this mess.
